Real Estate Ombudsman’s Office

The Real Estate Ombudsman’s Office offers a neutral platform for resolving complaints about damage and defects where it has not been possible to reach an agreement. As a mediator between the parties, our office aims to avoid the need for legal action through constructive mediation and to find a fair solution for all parties involved.

Conditions of the Real Estate Ombudsman’s Office

The services of the Real Estate Ombudsman’s Office are free of charge and covered by legal protection. A contact form is available for submitting enquiries, which can be used to communicate concerns easily and efficiently. Every enquiry is treated with the utmost care and attention.

Procedure - Submitting a complaint

1. Contact with the contracting party

Contact the contracting party directly concerned and describe your problem. Experience has shown that most disputes can be resolved in this manner.

2. Contact the ombudsman’s office

If it is not possible to resolve your issue directly, please use our contact form to send us the relevant information and correspondence. Describe your problem in detail, the reasons for your dissatisfaction and the full history of the case. On this basis, the ombudsman’s office will carry out a thorough assessment and make a recommendation aimed at finding common ground between the parties involved.

3. Submitting an appeal

If the recommendation in the first instance does not meet your expectations, you have the opportunity to lodge an appeal with the Ombudsman Board. The Ombudsman Board will then deal with the case and make its own independent decision.

4. Steps under civil law

If one of the contracting parties does not agree with the decision reached by the Ombudsman Board in the second instance, the only remaining option is to take legal action under civil law. The ombudsman’s office does not represent the parties and is neutral. However, the decisions of the first and second instance can be used by the court.
